The purpose of this essay is to advocate for including jurilinguistics in legal education. It presents jurilinguistics as a tool for understanding law and therefore supports continuing efforts to teach it. Knowing it is not unique, this essay proposes a jurilinguistic approach that focuses on the in-between of legal translation and comparative law. The proposal outlines the importance of educating in the capabilities of teaching a particular subject in a language other than their official one. The idea is to let (...) the Other help to understand the Self. Particularly pertinent in transnational law programs, it is a multicultural approach that not only recognizes the other, but also embraces it. (shrink)

Al pasar de una figura universal y abstracta, a una concreta y real, el sistema de la simpatía permite pensar en la continuidad que hay entre (...) la comunidad moral y la comunidad política y también en su ruptura, cuando la segunda se convierte en el espacio que permite manejar la exclusión que puede generar la primera. La invisibilidad de algunos miembros de la comunidad moral exige la creación de un espacio de tolerancia para evitar la violencia simbólica que implica la negación de participar en la comunicación afectiva de la simpatía. ABSTRACT The system of sympathy introduces a change in the figure of the other with respect to the school of moral sense. The reconstruction of this change reveals an important difference between A. Smith and his Scottish Enlightenment predecessors, which allows for the examination of the role of politics in Smith's work from a new angle. By replacing an abstract, universal figure with a concrete, actual one, the system of sympathy makes it possible to think the continuity between the moral community and the political community, but also its disruption, whenever the latter becomes a space to handle the exclusion that might be generated by the former. The invisibility of some of the members of the moral community requires the creation of a space of tolerance in order to avoid the symbolic violence entailed by the refusal to participate in the affective communication of sympathy. RESUMO Ao reconstruir a mudança na figura do outro entre a escola do sentido moral e o sistema da simpatia, é possível estabelecer uma diferença importante entre A. Smith e seus antecessores na Ilustração escocesa e explorar, sob um novo ângulo, o lugar que a política ocupa na obra de Smith. Ao passar de uma figura universal e abstrata para uma concreta e real, o sistema da simpatia permite pensar na continuidade que há entre a comunidade moral e a comunidade política e também em sua ruptura, quando a segunda se converte no espaço que permite manejar a exclusão que pode gerar a primeira. The milestone category that is frequently used to refer to the COVID 19 pandemic is called into question to propose that the use of this category is rather what generates a distinction between a past time or a before and a future time or an after. It is proposed that the possibility that this has been erected as a milestone is given by processes that are maintained both globally and locally, even though what allows the appearance of unprecedented events for (...) the Chilean health system is precisely the need to articulate its actions and markedly neoliberal rationalities with global logics. It is specified in the penetration of technological and biopolitical frameworks in the ways of life of the population worldwide and in the notions regarding how to live, and in the colonial matrix of knowledge / power that is at the base of the historical conception of the world system. In this paper we argue that the different positions taken by Dyson and Feynman on Feynman diagrams’ representational role depend on different styles of scientific thinking. We begin by criticizing the idea that Feynman Diagrams can be considered to be pictures or depictions of actual physical processes. We then show that the best interpretation of the role they play in quantum field theory and quantum electrodynamics is captured by Hughes' Denotation, Deduction and Interpretation theory of models (DDI), where “models” are (...) to be interpreted as inferential, non-representational devices constructed in given social contexts by the community of physicists. Bernard Mandeville denunciou a filosofia moral de seu tempo, tanto suas dimensões teóricas quanto práticas, como elitista e contrária à natureza humana. As explicações e recomendações derivadas dessa filosofia moral, segundo Mandeville, eram inadequadas para entender e governar a sociedade comercial. Mandeville examinou as explicações existentes sobre a natureza humana, confrontou-as com o que apresentou como fatos e desvendou suas contradições. Isso leva ao desafio de Mandeville: aceitar as coisas como elas são ou assumir a responsabilidade da transformação. Este é (...) o desafio que pretendo explorar neste artigo. Podemos continuar vivendo em uma sociedade altamente desigual baseada no orgulho e na vergonha ou podemos criar incentivos que levem a um cálculo diferente das paixões de acordo com um critério utilitário. This paper deals with one of the first attempts to measure simple reactions in humans. The Swiss astronomer Adolph Hirsch investigated personal differences in the speed of sensory transmission in order to achieve accuracy in astronomy. His controversial results, however, started an intense debate among both physiologists and astronomers who disagreed on the nature of these differences. Were they due to different eyes or brains, or to differences in skill and education? Furthermore, they debated how to eliminate them. Some, for (...) example, wanted to eliminate the observer, and prescribed the use of new technologies like the electro-chronograph or photography, while others believed in discipline and education. By debating the nature of these differences, astronomers and physiologists sketched both different conceptions of ‘man’ and different paths to objectivity. These diverse conceptions, moreover, were tied to current nineteenth-century debates, such as the benefits or disadvantages of railroads, telegraphy and the standardization of time and longitudes. By focusing on the debates surrounding the speed of sensory transmission, this paper reevaluates the history of astronomy, physiology and experimental psychology. Experiential imagination consists in an imaginative projection that aims at simulating the experiences one would undergo in different circumstances. It has been traditionally thought to play a role in how we build our lives, engage with other agents, and appreciate art. Although some philosophers have recently expressed doubts over the capacity of experiential imagination to offer insight into the perspective of someone other than our present-selves, experiential imagination remains a much sought-after tool. This paper substantiates pessimism about the epistemological value (...) of these uses of experiential imagination by developing an embodied approach. Our thesis is that experiential imagination is _robustly embodied_ because the _sociohistorically situated_ body makes an irreducible contribution to the imaginative project, and that, as such, it is constrained by who we are as _concrete_ agents. We argue that experiential imagination is an embodied, virtual exploration of imagined scenarios that depends on our situated history of sensorimotor and affective interactions. We conclude that experiential imagination is much more limited than commonly acknowledged, as it can hardly be divorced from who we are and where we have been. (shrink)

During the late nineteenth century, scientists around the world disagreed as to the types of instruments and methods that should be used for determining the most important constant of celestial mechanics: the solar parallax. Venus’s 1874 transit across the sun was seen as the best opportunity for ending decades of debate. However, a mysterious “black drop” that appeared between Venus and the sun and individual differences in observations of the phenomenon brought traditional methods into disrepute. To combat these difficulties, the (...) astronomer Jules Janssen devised a controversial new instrument, the “photographic revolver,” that photographed Venus at regular intervals. Another solution came from physicists, who rivaled the astronomers’ dominance in precision measurements by deducing the solar parallax from physical measurements of the speed of light. Yet other astronomers relied on drawings and well‐trained observers. The new space emerging from this debate was characterized by a decline in faith in photography and in geometry and by the growing realization of the importance of alternative elements needed for establishing scientific truths: power and authority, skill and discipline, standardization, mechanical reproducibility, and theatricality. By examining the “cinematographic turn” in science and its alternatives, this essay brings to light unexplored multidisciplinary connections that contribute to the histories of psychology, philosophy, physics, and film studies. En este artículo, nos preguntamos si es pertinente un análisis del personaje de Medea de Eurípides, y más concretamente, de su filicidio, a la luz de la doctrina aristotélica de la acción. Resulta dudoso, y quizás equívoco, hablar de "responsabilidad" (en sentido aristotélico) en el caso de la heroína, ya que sus motivaciones, como las de todo héroe trágico, tienen un doble signo: enfrentado a una ἀνάγκη superior, también desea lo que está forzado a hacer. Además, Medea no es una (...) mujer común: es un personaje ontológicamente complejo que participa, más de lo que frecuentemente se ha enfatizado, del plano divino. In this article we wonder if it is pertinent to analyse the character of Euripides' Medea and, more precisely, her filicide, in the light of Aristotle's doctrine of action. With regard to the heroine, it is doubtful and perhaps confusing to talk about "responsibility" (in Aristotelian terms) because her motivations, as all tragic heroes', are two-sided: faced to a superior ἀνάγκη he wants what he is forced to do as well. In addition, Medea is not an ordinary woman: she is an ontologically complex character that has a share in the divine level, a share which is more crucial than what has usually been emphasized. This paper offers a critical assessment of the current state of the debate about the identity and individuality of material objects. Its main aim, in particular, is to show that, in a sense to be carefully specified, the opposition between the Leibnizian ‘reductionist’ tradition, based on discernibility, and the sort of ‘primitivism’ that denies that facts of identity and individuality must be analysable has become outdated. In particular, it is argued that—contrary to a widespread consensus—‘naturalised’ metaphysics supports both the acceptability (...) of non-qualitatively grounded (both ‘contextual’ and intrinsic) identity and a pluralistic approach to individuality and individuation. A case study is offered that focuses on non-relativistic quantum mechanics, in the context of which primitivism about identity and individuality, rather than being regarded as unscientific, is on the contrary suggested to be preferable to the complicated forms of reductionism that have recently been proposed. More generally, by assuming a plausible form of anti-reductionism about scientific theories and domains, it is claimed that science can be regarded as compatible with, or even as suggesting, the existence of a series of equally plausible grades of individuality. The kind of individuality that prevails in a certain context and at a given level can be ascertained only on the basis of the specific scientific theory at hand. (shrink)

The year 2005 has been named the World Year of Physics in recognition of the 100th anniversary of Albert Einstein's "Miracle Year," in which he published four landmark papers which had deep and great influence on the last and the current century: quantum theory, general relativity, and statistical mechanics. Despite the enormous importance that Einstein’s discoveries played in these theories, most physicists adopt a version of quantum theory which is incompatible with the idea that motivated Einstein in the first place. (...) This seems to suggest that Einstein was fundamentally incapable of appreciating the `quantum revolution,’ and that his vision of physics as an attempt to reach a complete and comprehensive description of reality was ultimately impossible to obtain. Relativity theory has provided us with a picture of reality in which the world can be though as independent on who observes it, and the same can be said for statistical mechanics. Instead, quantum mechanics seems to suggest that physical objects do not exist `out there’ when someone is not observing them. In this framework, it is often suggested that any kind of causal explanation is impossible in the atomic and subatomic world, and therefore should be abandoned. This is why many think that it is in principle impossible for quantum theory to provide us with a coherent and comprehensive view of the world, in contrast with what happens with relativity and statistical mechanics. Is it really impossible to pursue Einstein’s ideal of physics also in the quantum framework? This book argues that this is not the case: the central idea is that Einstein’s vision of physics is still a live option, and indeed it is the one that best allows obtaining a unitary understanding of our physical theories. Alberto Magno designa una división tripartita para la filosofía, en la cual la “filosofía real” se encuentra compuesta por la física, la matemática y la metafísica, dispuestas de este modo secundum ordinem doctrinae. El saber metafísico constituye el saber más excelso y es denominado scientia divina, que se articula con la teología a modo de una gradación de distintos estadios de inteligibilidad, y pone de manifiesto el problema dialéctico fe-razón.

The paper argues that the formulation of quantum mechanics proposed by Ghirardi, Rimini and Weber (GRW) is a serious candidate for being a fundamental physical theory and explores its ontological commitments from this perspective. In particular, we propose to conceive of spatial superpositions of non-massless microsystems as dispositions or powers, more precisely propensities, to generate spontaneous localizations. We set out five reasons for this view, namely that (1) it provides for a clear sense in which quantum systems in entangled states (...) possess properties even in the absence of definite values; (2) it vindicates objective, single-case probabilities; (3) it yields a clear transition from quantum to classical properties; (4) it enables to draw a clear distinction between purely mathematical and physical structures, and (5) it grounds the arrow of time in the time-irreversible manifestation of the propensities to localize. ArgumentIn 1895 when the Lumière brothers unveiled their cinematographic camera, many scientists were elated. Scientists hoped that the machine would fulfill a desire that had driven research for nearly half a century: that of capturing the world in its own image. But their elation was surprisingly short-lived, and many researchers quickly distanced themselves from the new medium. The cinematographic camera was soon split into two machines, one for recording and one for projecting, enabling it to further escape from the laboratory. (...) The philosopher Henri Bergson joined scientists, such as Etienne-Jules Marey, who found problems with the new cinematographic order. Those who had worked to make the dream come true found that their efforts had been subverted. This essay focuses on the desire to build a cinematographic camera, with the purpose of elucidating how dreams and reality mix in the development of science and technology. It is about desired machines and their often unexpected results. The interplay between what “is” (the technical), what “ought” (the ethical), and what “could” be (the fantastical) drives scientific research. (shrink)

In the first part of the paper I argue that an ontology of events is precise, flexible and general enough so as to cover the three main alternative formulations of quantum mechanics as well as theories advocating an antirealistic view of the wave function. Since these formulations advocate a primitive ontology of entities living in four-dimensional spacetime, they are good candidates to connect that quantum image with the manifest image of the world. However, to the extent that some form of (...) realism about the wave function is also necessary, one needs to endorse also the idea that the wave function refers to some kind of power. In the second part, I discuss some difficulties raised by the recent proposal that in Bohmian mechanics this power is holistically possessed by all the particles in the universe. (shrink)

Debates about the ontological implications of the general theory of relativity have long oscillated between spacetime substantivalism and relationism. I evaluate such debates by claiming that we need a third option, which I refer to as “structural spacetime realism.” Such a tertium quid sides with the relationists in defending the relational nature of the spacetime structure, but joins the substantivalists in arguing that spacetime exists, at least in part, independently of particular physical objects and events, the degree of “independence” being (...) given by the extent to which geometrical laws exist “over and above” physical events exemplifying them. By showing that structural spacetime realism is the natural outcome of a semantic, model-theoretic approach to the nature of scientific theories, I conclude by arguing that the notion of partial isomorphic representation is the most plausible candidate to connect spacetime models with reality. We discuss the three dominant models of the phenomenological literature pertaining to temporal consciousness, namely the cinematic, the retentional, and the extensional model. This is first done by presenting the distinction between acts and contents of consciousness and the assumptions underlying the different models concerning both the extendedness and duration of these two components. Secondly, we elaborate on the consequences related to whether a perspective of direct or indirect realism about temporal perceptions is assumed. Finally, we review some relevant findings (...) from the psychology and neuroscience of temporality in order to decide which of the three models of time consciousness is better confirmed from an empirical viewpoint. Depending on the time scale, all three models of temporal consciousness might apply. We specifically argue in favor of an extensional model of time consciousness for the experienced present where the acts and contents of consciousness are both extended. The retentional model might apply to longer time intervals covered by working memory. In addition, a predictive component is highlighted as decisive for an understanding of temporality. (shrink)

In the literature on the compatibility between the time of our experience and the time of physics, the special theory of relativity has enjoyed central stage. By bringing into the discussion the general theory of relativity, I suggest a new analysis of the misunderstood notion of becoming, developed from hints in Gödel's published and unpublished arguments for the ideality of time. I claim that recent endorsements of such arguments, based on Gödel's own ‘rotating’ solution to Einstein's field equation, fail: once (...) understood in the right way, becoming can be shown to be both mind-independent and compatible with spacetime physics. Being a neededtertium quidbetween views of time traditionally regarded as in conflict, such a new approach to becoming should also help to dissolve a crucial aspect of the century-old debate between the so-called A and B theories of time. In this paper, we evaluate some proposals that have been put forward to clarify the ontological consequences of relational quantum mechanics. We first focus on priority monism and ontic structural realism and argue that these views are not suitable for providing an ontological interpretation of the theory. Then, we discuss an alternative interpretation that we regard as more promising, based on so-called ‘metaphysical coherentism’, which we also connect to the idea of an event-based, or ‘flash’, ontology.

The literature on the compatibility between the time of our experience--characterized by passage or becoming--and time as is represented within spacetime theories has been affected by a persistent failure to get a clear grasp of the notion of becoming, both in its relation to an ontology of events tt"spreadtt" in a four-dimensional manifold, and in relation to temporally asymmetric physical processes.In the first part of my paper I try to remedy this situation by offering what I consider a clear and (...) faithful explication of becoming, valid independently of the particular spacetime setting in which we operate. Along the way, I will show why the metaphysical debate between the so-called tt"presentiststt" and tt"eternaliststt" is completely irrelevant to the question of becoming, as the debate itself is generated by a failure to distinguish between a tensed and a tenseless sense of tt"existencett". After a much needed distinction between absolute and relational becoming, I then show in what sense classical spacetime physics presupposes both types of becoming, for the simple reason that spacetime physics presupposes an ontology of events. As a consequence, not only does it turn out that using physics to try to provide empirical evidence for the existence of becoming amounts to putting the cart before the horses, but also that the order imposed by tt"the arrow of becomingtt" is more fundamental than any other physical arrow of time, despite the fact that becoming cannot be used to explain why entropy grows, or retarded electromagnetic radiation prevails versus advanced radiation. In this paper I review three different positions on the wave function, namely: nomological realism, dispositionalism, and configuration space realism by regarding as essential their capacity to account for the world of our experience. I conclude that the first two positions are committed to regard the wave function as an abstract entity. The third position will be shown to be a merely speculative attempt to derive a primitive ontology from a reified mathematical space. Without entering any discussion about nominalism, I (...) conclude that an elimination of abstract entities from one’s ontology commits one to instrumentalism about the wave function, a position that therefore is not as unmotivated as it has seemed to be to many philosophers. By briefly reviewing three well-known scientific revolutions in fundamental physics (the discovery of inertia, of special relativity and of general relativity), I claim that problems that were supposed to be crying for a dynamical explanation in the old paradigm ended up receiving a structural explanation in the new one. This claim is meant to give more substance to Kuhn’s view that revolutions are accompanied by a shift in what needs to be explained, while suggesting at the same time the existence (...) of a pattern that is common to all of the discussed case-studies. It remains to be seen whether also quantum mechanics, in particular entanglement, conforms to this pattern. (shrink)

The main claim that I want to defend in this paper is that the there are logical equivalences between eternalism and perdurantism on the one hand and presentism and endurantism on the other. By “logical equivalence” I mean that one position is entailed and entails the other. As a consequence of this equivalence, it becomes important to inquire into the question whether the dispute between endurantists and perdurantists is authentic, given that Savitt (2006) Dolev (2006) and Dorato (2006) have (...) cast doubts on the fact that the debate between presentism and eternalism is about “what there is”. In this respect, I will conclude that also the debate about persistence in time has no ontological consequences, in the sense that there is no real ontological disagreement between the two allegedly opposite positions: as in the case of the presentism/eternalism debate, one can be both a perdurantist and an endurantist, depending on which linguistic framework is preferred. La literatura griega registra antecedentes de los recursos propios del slapstick en diversos géneros como la épica, la poesía yámbica, la fábula y la comedia. La comedia de Menandro, en particular El Misántropo, hace uso profuso de esta serie de tópicos del humor físico para caracterizar al anciano Cnemón, su personaje central. En varias de sus obras, el slapstick se asocia específicamente al personajetipo del anciano gruñón. El Misántropo retoma claramente el uso punitivo tradicional del recurso, que resulta dominante en (...) la comedia de Aristófanes, en cuanto el slapstick apunta a castigar y transformar la conducta antisocial de Cnemón. No se trata de un recurso asociado al mero entretenimiento, sino que condena a su víctima mediante el escarnio de la agresión y la risa, o bien a su victimario cuando ejerce una violencia descontextualizada, como lo hace el misántropo. En este artículo teórico se presenta el modelo metodológico de los Mapas Corporales como una estrategia para la producción de conocimientos sobre el cuerpo en investigaciones biográficas. Este modelo aborda la corporeidad como un lugar por el que fluye el trazado de construcciones intersubjetivas que regulan al sujeto, permitiendo textualizar procesos subjetivos que, con las estrategias tradicionales del método biográfico, quedan invisibles, en tanto, lenguajes semiótico-materiales encarnados. A nivel interpretativo se busca la comprensión del orden normativo inscrito en el cuerpo (...) donde se articulan aspectos relativos a procesos psicosexuales y modelos de género anclados en la cultura, como así también, la expresión de transgresiones o disidencias a las ideologías de género vigentes. This theoretical paper refers to a methodological model of Body Maps as a strategy to create knowledge on corporeity in bibliographic research. This model approaches the body as a place through which the intersubjective construction path regulating the subject flows, allowing the textualization of subjective processes which, together with the traditional strategies of the bibliographic method, remain invisible as embodied semiotic-material languages. At an interpretational level, the paper deals with understanding the normative order of the body where aspects relative to psychosexual processes and gender models rooted in the culture articulate, along with the expression of transgression to current gender ideologies. This paper situates Einstein's theory of relativity within broader networks of communication. The speed of light, explained Einstein, was an unsurpassable velocity if , and only if , it was considered in terms of »arbitrary« and »voluntary« signals. Light signals in physics belong within a broader set of signs and symbols that include communication and military signals, understood by reference to Helmholtz, Saussure, media philosophies from WWII to '68 (Lavelle, Ong, McLuhan) and Derrida. Once light signals in physics are considered (...) in relation to semaphore, print, telegraph, radio, computers and tape recorders, Kittler and Habermas provide us with conflicting ways for understanding science and technology, rationality and consensus. We conclude with a study of »flash and bang« in popular accounts of relativity theory to understand the role of theoretical science in the transmission of information and violence. (shrink)
